New franchisor | The project

The franchise project starts from within and there are several points that must be worked on before launching the concept to the market.

  • Definition of the operation with the franchised establishments. It is necessary to clarify how, through what channels and how often the franchise center will interact or communicate with its network of establishments, as well as the measures to be followed in the face of possible requirements/incidents.
  • Creation of franchise manuals. The franchise manuals must collect each and every one of the operational and commercial elements that make the business what it is. These must be collected in a clear and concise manner so that they constitute the frame of reference for consultation of the franchisee in the management of his business.
    The number and extension of the manuals will depend on the type of franchise and the complexity of it. Currently, chains often 'simplify' these manuals in pursuit of greater digital support constantly updated.
  • Pre-franchise contract. Royal Decree 201/2010 of February 26 provides for the obligation of the franchisor to provide the franchisee, with a minimum of twenty days prior to the signing of the contract or franchise pre-contract, accurate and non-misleading information on issues such as: identification of the franchisor, description of the sector, experience of the franchising company, characteristics of the franchise, dimension of the network, among others. It is usual to collect this information in a document with commercial format to be used in the first contact with the candidate, also providing the most notable characteristics of the chain and accession conditions.
  • Franchise contract. The franchise agreement includes the nature and characteristics of the legal relationship established between franchisor and franchisee, as well as the rights and obligations to be fulfilled by both parties upon signature, validity and termination.
    The drafting of a good franchise contract will lay a solid foundation on which to build a clear and honest collaboration, covered in the event of possible incidents, external variations or improper acts by any of the parties.
